Update on Ontario Energy and Water Efficiency Regulation

On December 6, 2018, Ontario passed the Green Energy Repeal Act, 2018, which, among other things, repealed the Green Energy Act, 2009, revoked O. Reg. 404/12 and re-introduced the energy efficiency and conservation provisions that existed under the Green Energy Act, 2009 in Part II.3 of the Electricity Act, 1998. These amendments were proclaimed into force on January 1, 2019.

O. Reg. 509/18 (Energy and Water Efficiency - Appliances and Products) made under the Electricity Act, 1998 also came into force on January 1, 2019. This new regulation replicates the requirements under O. Reg. 404/12, including only formatting changes to the previous regulation (i.e. clause renumbering and updates to cross-references).

There were no changes to existing products or product requirements. All products that were previously regulated under O. Reg. 404/12 are now regulated under O. Reg. 509/18 with no change to compliance date, scope, test method, or efficiency requirements.
